If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and Yupfans. Your use of the Platform indicates your acceptance of these terms and our Privacy Policy.

Important: These terms may be updated periodically. Continued use of the Platform after changes constitutes acceptance of the updated terms.

2. Definitions
For the purpose of these Terms and Conditions:

• “Creator” means any user who uploads, posts, or distributes content on the Platform
• “Subscriber” means any user who pays for access to exclusive content
• “Content” means any material, including but not limited to text, images, videos, audio, and other media
• “Exclusive Content” means content that is only available to paying subscribers
• “Platform” means the Yupfans website, mobile applications, and related services
• “Intellectual Property” means all copyrights, trademarks, patents, and other proprietary rights

3. User Eligibility
To use Yupfans, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Platform under applicable laws
• Provide accurate and complete registration information

Age Verification: We may require age verification for certain features. Providing false information is grounds for immediate account termination.

Geographic Restrictions: The Platform may not be available in all jurisdictions. You are responsible for ensuring your use complies with local laws.

4. Creator Terms
Content Ownership and Licensing
As a Creator, you retain ownership of your content but grant Yupfans a limited license to:

• Host, store, and distribute your content on the Platform
• Process payments for your content
• Promote your content within the Platform
• Create thumbnail images and previews
• Revenue Sharing
• Yupfans operates on a revenue-sharing model:

Creators retain 80% of net revenue from their content
Yupfans retains 20% to cover platform costs and operations
Payment processing fees are deducted before revenue sharing
Minimum payout threshold is $50
Content Guidelines
All content must comply with our Community Guidelines and applicable laws. Prohibited content includes:

• Illegal activities or contentNon-consensual intimate content
• Content involving minors
• Violent or harmful content
• Harassment or hate speech

5. Subscriber Terms
Subscription and Billing
As a Subscriber, you agree to:

• Pay all applicable fees for content access
• Provide accurate payment information
• Authorize recurring charges for subscriptions
• Notify us of any billing disputes within 60 days

Content Access Rights
Your subscription grants you:

Personal, non-commercial access to subscribed content
The right to view content during your active subscription period
Limited download rights where explicitly permitted
Prohibited Activities
You may not:

Share, distribute, or resell content outside the Platform
Record, screenshot, or copy content without permission
Use content for commercial purposes
Attempt to circumvent payment systems

6. Intellectual Property Rights
Creator Content
Creators retain all intellectual property rights in their content. By uploading content, Creators represent and warrant that:

• They own or have the right to use all content uploaded
• Their content does not infringe on third-party rights
• They have obtained all necessary permissions and releases
• Platform Intellectual Property

Yupfans owns all rights to:

The Platform’s software, design, and functionality
Yupfans trademarks, logos, and branding
Platform-generated analytics and aggregated data
DMCA Compliance
We respect intellectual property rights and will respond to valid DMCA takedown notices. To report copyright infringement, contact our designated agent with:

Description of the copyrighted work
Location of the infringing content
Your contact information
Good faith statement of unauthorized use

7. Privacy and Security
Data Protection
We are committed to protecting your privacy and personal data. Our practices include:

You are responsible for:

Provide details about the breach and affected data
Outline steps being taken to address the issue
Offer credit monitoring services if appropriate

8. Account Termination
Termination by User
You may terminate your account at any time by:

• Accessing your account settings and selecting “Delete Account”

We may terminate or suspend your account for:

Violation of these Terms and Conditions
Fraudulent or illegal activity
Repeated community guideline violations
Non-payment of fees
Inactive accounts (after 2 years of inactivity)
Effects of Termination

• Upon termination:
  Access to the Platform will be immediately revoked
• Creator content may be removed from the Platform
• Outstanding payments will be processed according to our payment terms
• Some data may be retained for legal and operational purposes

9. Disclaimers and Limitations
Service Availability
The Platform is provided “as is” and “as available.” We do not guarantee:

• Continuous, uninterrupted access to the Platform
• Error-free operation of all features
• Compatibility with all devices and browsers
• Permanent availability of any specific content

Limitation of Liability
To the maximum extent permitted by law, Yupfans shall not be liable for:

Indirect, incidental, or consequential damages
Loss of profits, data, or business opportunities
Damages arising from user-generated content
Third-party actions or content
Indemnification
You agree to indemnify and hold Yupfans harmless from any claims, damages, or expenses arising from:

Your use of the Platform
Your content and its distribution
Your violation of these terms
Your infringement of third-party rights

10. Dispute Resolution
Governing Law

Yupfans may assign these terms or any rights hereunder without your consent. You may not assign your rights or obligations without our written consent.

Waiver
Our failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision.

Force Majeure
Neither party shall be liable for delays or failures in performance due to circumstances beyond their reasonable control, including natural disasters, government actions, or technical failures.
